In accordance with the Digital Millennium Copyright Act (the “DMCA”), 17 U.S.C. §512, we respond to clear notices of alleged copyright infringement that comply with the requirements set out in this policy. This policy explains how copyright owners (or their authorized agents) can submit a takedown notice, how a user whose content has been removed can submit a counter-notification, and how we handle repeat infringers.
This policy applies globally to all content made available through CINERIOS, including content on cinerios.com and across the CINERIOS platform.

Takedown notices
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that material available on CINERIOS infringes your copyright, you may submit a written notice of claimed infringement (a “DMCA takedown notice”) to our designated copyright agent identified below.
To be effective under 17 U.S.C. §512(c)(3), your takedown notice must be a written communication that includes substantially all of the following:
Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees. If you are unsure whether material infringes your copyright, you may wish to consult an attorney before submitting a notice.
Where to send notices
ELSE GROUP LLC has designated the following agent to receive notifications of claimed infringement under the DMCA. Please send all takedown notices and counter-notifications to:
Email is the fastest way to reach our designated agent and is the preferred method of contact. Notices that do not substantially comply with the DMCA’s requirements may not be actionable.
If your content was removed
If your content was removed or disabled in response to a DMCA takedown notice and you believe that the removal was the result of a mistake or misidentification, you may submit a written counter-notification to our designated copyright agent under 17 U.S.C. §512(g).
To be effective, your counter-notification must include substantially all of the following:
Upon receipt of a valid counter-notification, we may forward it to the original complaining party. If that party does not notify us within 10 to 14 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material, as permitted by Section 512(g).
Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be liable for damages. Consider seeking legal advice before submitting a counter-notification.
Repeat infringers
In accordance with 17 U.S.C. §512(i), ELSE GROUP LLC has adopted and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.
We may, in our sole discretion, limit access to CINERIOS, remove content, and terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement. Determinations about repeat infringement are made on a case-by-case basis and take into account the totality of the circumstances.
